A 31-year-old man was convicted by the Lucerne criminal court for attempted (eventual) willful killing, rape and deprivation of liberty. The man from Brazil choked his former partner into unconsciousness in the kitchen on the night of April 12, 2018. According to the well-founded judgment of the Lucerne criminal court, there was a greatly increased risk of death for the woman.

Apartment keys taken away and raped

After the woman regained consciousness, the man made her promise not to tell anyone. He threatened her and made it clear to her that he was capable of killing her. After the incident in the kitchen, the man said he went to the bedroom. There was another argument there. The man threw the woman to the ground. Despite the woman's request, he did not leave the apartment. When she was about to leave the apartment, the man took the apartment key with him. After another scuffle, he went to bed.

As the man testified at the trial, he later wanted to reconcile himself with sex with his ex-partner. However, according to the judgment of the court, this reconciliation was rape. The woman made it clear to her ex-boyfriend on several occasions that she did not want sexual intercourse. The man admitted at the trial that she said “no” first. After that, however, sexual intercourse did occur. The 31-year-old thinks that when you love each other, it's normal to have sexual intercourse, even if the other person doesn't want to.

The defense attorney emphasized at the hearing that the victim endured sexual intercourse. During the interrogations, the man also testified that they often had consensual hard sex with beatings and gagging. So also on the evening mentioned. However, he later admitted the allegations made against him.

The husband and wife were in a relationship for around two years. Even after the relationship ended, they continued to meet and became intimate. However, they often quarreled. The 31-year-old also became violent towards the woman. The police were alerted several times about this. In 2016, he also injured their daughter. Thereupon, by order of the court, he was no longer allowed to approach the place of residence of the woman and her children, which he continued to do.

Accused suffers from personality disorder

The accused suffers from a dissocial personality disorder with additional psychopathic features. In the course of the investigation, several forensic-psychiatric reports were therefore prepared. As a young person, the accused was housed in several homes and clinics and has several previous convictions for threats, violence and sexual offenses. He is in the early execution of measures, as the «Luzerner Zeitung» writes.

The criminal court sentenced the 31-year-old to a prison term of six years and eleven months. An inpatient measure will be ordered with postponement of execution. The accused also has to pay the woman, who appeared as a private plaintiff, a satisfaction of 14,000 francs and bears the procedural costs of around 58,000 francs.
